Privacy Policy

This policy explains what personal information we collect, how we use and disclose it, how long we keep it, and the choices and rights you have. It forms part of our Terms of Service.

01ABOUT THIS POLICY

1.1 Who We Are. Land Atlas LLC ("Land Atlas," "we," "us," or "our") operates the Land Atlas platform, a software as a service application for real estate professionals, investors, wholesalers, land developers, and builders (the "Platform").

1.2 What This Policy Covers. This Privacy Policy describes how we collect, use, disclose, and protect personal information about:

  • individuals who create or use a Land Atlas account, including account holders and team members;
  • prospective customers who contact us, request information, or sign up for our communications; and
  • visitors to www.landatlas.com and our other public web properties.

We refer to these individuals collectively as "you."

1.3 What This Policy Does Not Cover. This Privacy Policy does not describe:

(a) how personal information about property owners or other individuals appearing in property records or skip tracing results is handled. That information is not covered by this Policy;

(b) how Land Atlas users handle personal information they obtain through the Platform. As described in our Terms of Service, a user who obtains contact information through the Platform becomes the controller or business with respect to that information and is independently responsible for its handling. Land Atlas does not control and is not responsible for user practices; or

(c) the practices of third party websites, applications, or services linked from or integrated with the Platform.

1.4 Relationship to the Terms of Service. This Policy is incorporated into and forms part of the Land Atlas Terms of Service. Capitalized terms not defined here have the meanings given there. Where this Policy and the Terms of Service conflict as to the handling of your personal information, this Policy governs.

1.5 Geographic Scope. The Platform is offered from and operated in the United States and is intended for use by businesses located in the United States. We do not offer the Platform to individuals in the European Economic Area or the United Kingdom.

02INFORMATION WE COLLECT

2.2 Information We Collect Automatically.

2.3 Information From Other Sources. We receive information about you from our payment processor, including transaction status, payment method type, and fraud signals; from our advertising and attribution providers, including the identity and attribution data described in Section 5; from other users who invite you to join their account as a team member; and from publicly available business sources.

2.4 Our Access to Your Content. So that we can operate the Platform, provide support, and enforce our Terms of Service, authorized Land Atlas personnel are able to access the content stored in your account, including your CRM records, contracts and other documents, saved searches, notes, and uploaded lists. Access is limited to personnel whose role requires it and is used only for the purposes described in Section 3, including troubleshooting issues you report, investigating suspected fraud or abuse, and complying with legal obligations. We do not review Your Content for any other purpose, and we do not disclose it except as described in Section 6.

2.5 Sensitive Personal Information. Under California law, account credentials in combination with a password are "sensitive personal information." We collect this only to authenticate you and secure your account, and we do not use or disclose it for any purpose beyond those permitted under Cal. Civ. Code § 1798.121(a). Accordingly, the right to limit the use of sensitive personal information does not apply to our practices. We do not collect Social Security numbers, driver's license or passport numbers, precise geolocation, racial or ethnic origin, religious beliefs, union membership, health information, biometric identifiers, or information concerning sex life or sexual orientation.

2.6 Children. The Platform is offered only to individuals aged eighteen (18) and older acting for business purposes. We do not knowingly collect personal information from anyone under eighteen, and we do not knowingly sell or share the personal information of anyone under sixteen. If we learn we have collected such information, we will delete it.

03HOW WE USE INFORMATION

3.1 Providing the Platform. Creating and administering your account; authenticating you; delivering the features, data, and tools you request; metering and deducting credits; generating exports; transmitting documents you send; and storing and making available Your Content.

3.2 Billing and Payments. Processing charges and credit purchases, managing renewals, retrying failed payments, issuing refunds, calculating taxes, and responding to billing and payment disputes.

3.3 Support. Responding to your questions, troubleshooting issues, accessing your account and Your Content where necessary to resolve a problem, and maintaining records of support interactions.

3.4 Security, Fraud Prevention, and Enforcement. Detecting and preventing unauthorized access, credential sharing, account takeover, systematic extraction of Platform data, circumvention of usage limits, and other abuse; investigating suspected violations of our Terms of Service; and protecting the rights, property, and safety of Land Atlas, our users, our data suppliers, and the public.

3.5 Improving the Platform. Analyzing usage patterns, diagnosing defects, measuring feature adoption, testing changes, and developing new features.

3.6 Communications. Sending you transactional and service messages by email and text message, including receipts, renewal and billing notices, security alerts, service announcements, and policy updates. Sending you marketing and promotional messages by email and text message about Land Atlas products, features, offers, and events, where you have provided the consent required by law. See Section 4.

3.7 Marketing, Advertising, and Attribution. Measuring the performance of our marketing, attributing signups and purchases to the campaigns that produced them, building and delivering advertising for Land Atlas on third party platforms, and creating audiences for that advertising. See Section 5.

3.8 Legal and Compliance. Complying with applicable law, responding to lawful requests and legal process, enforcing our agreements, establishing and defending legal claims, meeting obligations owed to our data suppliers, and satisfying tax, accounting, and recordkeeping requirements.

3.9 Business Transactions. Evaluating, negotiating, and completing a financing, merger, acquisition, reorganization, or sale of assets, subject to Section 6.4.

04EMAIL AND TEXT MESSAGE COMMUNICATIONS

4.1 Email. We send transactional email to the address on your account for as long as your account is active. These messages are part of the service and cannot be turned off while your account remains open. We also send marketing email, from which you may unsubscribe at any time using the link in any marketing message or by emailing privacy@landatlas.com.

4.2 Text Messages. Where you have provided your mobile number and the consent required by law, we may send you text messages relating to your account, your onboarding, service updates, and, where you have separately consented, marketing and promotional messages.

  • Opting out. Reply STOP to any text message to stop receiving further messages. Reply HELP for assistance, or contact support@landatlas.com.
  • Frequency. Message frequency varies.
  • Costs. Message and data rates may apply. We are not responsible for charges imposed by your carrier.
  • Consent is not a condition of purchase. You are not required to consent to receive marketing text messages in order to purchase or use the Platform.

4.3 Mobile Numbers Are Not Shared for Third Party Marketing. We do not sell, rent, or share your mobile telephone number or your text message consent with any third party for that third party's own marketing purposes. We disclose mobile numbers only to the service providers that deliver messages on our behalf, and only for that purpose.

4.4 Recording. Communications with our support and sales teams may be recorded or logged for quality assurance, training, and dispute resolution. Where notice or consent is required by law, it will be provided or obtained.

05COOKIES, PIXELS, AND ADVERTISING TECHNOLOGIES

5.1 What We Use. We and our providers use cookies, local storage, pixels, tags, server side tracking, and similar technologies to operate the Platform, remember your settings, keep you signed in, measure performance, understand how our sites are used, and measure and deliver advertising.

5.2 Categories.

  • Strictly necessary. Required for authentication, session management, security, and load balancing. These cannot be disabled without preventing the Platform from functioning.
  • Functional. Remember preferences such as saved filters, display settings, and language.
  • Analytics and attribution. Measure traffic, feature usage, campaign performance, and which marketing sources produced a signup or purchase.
  • Advertising. Deliver and measure Land Atlas advertising on third party platforms.

5.3 Advertising and Attribution Providers. We use the Meta Pixel, operated by Meta Platforms, Inc., and Hyros, an advertising attribution and tracking service. These technologies collect information including your IP address, device and browser information, page and event activity on our sites, and identifiers associated with you, and may use hashed identifiers derived from information such as your email address to match your activity across devices and to attribute it to a marketing campaign. Information collected through these technologies is transmitted to and processed by the providers and, in the case of the Meta Pixel, by Meta for advertising and measurement purposes.

5.4 This Constitutes "Sharing" Under California Law. Because the technologies described in Section 5.3 disclose identifiers and activity data to third parties for cross context behavioral advertising, this activity is treated as "sharing" of personal information under the California Consumer Privacy Act, and may be treated as "targeted advertising" under other state privacy laws, even though we receive no money for it. You may opt out at any time as described in Section 5.6 and Section 9.4.

5.5 We Do Not Sell Personal Information for Money. We do not sell your personal information for monetary consideration.

5.6 Your Choices.

  • Use the "Do Not Sell or Share My Personal Information" link in the footer of www.landatlas.com.
  • Transmit a Global Privacy Control or similar universal opt out signal from your browser. We treat such a signal as a valid opt out request for that browser and device.
  • Adjust cookie settings in our preference center where available, or block or delete cookies through your browser settings. Blocking strictly necessary cookies will prevent the Platform from functioning.
  • Opt out of certain advertising cookies through the Digital Advertising Alliance and Network Advertising Initiative industry opt out tools.
  • Adjust your advertising preferences directly with Meta through your Meta account settings.

5.7 Do Not Track. There is no common industry standard for interpreting browser "Do Not Track" signals, and we do not respond to them. We do honor Global Privacy Control signals as described above.

06HOW WE DISCLOSE INFORMATION

We do not disclose your personal information except as described in this Section.

6.1 Service Providers. We disclose personal information to vendors that perform services for us under written contracts limiting their use of the information to performing those services. Our provider categories include cloud hosting and storage; payment processing; electronic signature; property and parcel data supply; skip tracing data supply; email and text message delivery; customer support and ticketing; analytics, attribution, and advertising; artificial intelligence features; and accounting, tax, and legal advisors.

6.2 Advertising Platforms. As described in Section 5, we disclose identifiers and activity data to advertising and attribution platforms for cross context behavioral advertising and measurement.

6.3 At Your Direction. We disclose information as you direct, including transmitting documents you send through the Platform to the recipients you designate, and sharing account information with team members you invite.

6.4 Business Transactions. If Land Atlas is involved in a financing, merger, acquisition, reorganization, change of control, bankruptcy, or sale of all or substantially all of its assets or membership interests, personal information may be disclosed to counterparties and their advisors under confidentiality obligations and transferred as part of that transaction. We will require any acquirer to honor the commitments in this Policy with respect to transferred information, or to provide notice and an opportunity to object before materially changing them.

6.5 Legal and Protective Disclosures. We disclose personal information where we believe in good faith that disclosure is required by law or legal process; necessary to respond to a subpoena, court order, or governmental request; necessary to enforce our Terms of Service; necessary to detect, prevent, or address fraud, security, or technical issues; or necessary to protect the rights, property, or safety of Land Atlas, our users, our data suppliers, or the public.

6.6 Aggregated and Deidentified Information. We may create and use aggregated or deidentified information that cannot reasonably be used to identify you. We maintain such information in deidentified form, do not attempt to reidentify it, and require the same of recipients.

6.7 We Do Not Disclose Your Content for Advertising. We do not disclose Your Content, including your contracts, CRM records, notes, or uploaded lists, to advertising platforms or to any third party for that party's own marketing purposes.

07RETENTION

7.1 Our Approach. We retain personal information for as long as your account is active, and thereafter for as long as reasonably necessary to fulfill the purposes described in this Policy. Because our users are businesses whose records may remain relevant to ongoing transactions, tax obligations, and potential disputes long after an account closes, we do not automatically delete account information or Your Content when a subscription is cancelled or an account is closed. You may request deletion as described in Section 9.

7.2 Criteria We Apply. In determining how long to retain a category of information, we consider: how long the information is needed to provide the Platform and support you; whether you or a counterparty may reasonably need access to it in connection with a transaction; the limitations periods applicable to potential legal claims; our tax, accounting, and audit obligations; obligations owed to our data suppliers; the need to retain records evidencing your acceptance of our Terms of Service and your use of the Platform; the need to maintain suppression records so that we can continue to honor an opt out or deletion request; and the technical constraints of our backup systems, from which deleted data is removed on a rolling cycle rather than immediately.

7.3 Legal Holds. Where information is subject to a litigation hold, regulatory inquiry, or ongoing investigation, we retain it until the matter is resolved, notwithstanding any request or schedule described above.

08SECURITY

8.1 Our Measures. We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit using industry standard protocols, access controls limiting personnel access to what their role requires, and written confidentiality obligations for personnel and vendors.

8.2 No Guarantee. No method of transmission or storage is completely secure. We cannot and do not guarantee that personal information will not be accessed, disclosed, altered, or destroyed by breach of our safeguards.

8.3 Your Responsibilities. You are responsible for maintaining unique credentials, enabling multifactor authentication where available, limiting team member permissions to what each person needs, revoking team member access promptly when someone departs, securing your own devices and networks, and safeguarding any data you export from the Platform. Notify us promptly at support@landatlas.com if you suspect unauthorized access to your account.

8.4 Incident Notification. If we become aware of a security incident affecting your personal information, we will notify you and any applicable regulator as and when required by law.

09YOUR CHOICES AND PRIVACY RIGHTS

9.1 Access and Update. You can view and update most account information directly in your account settings.

9.2 Marketing Communications. Unsubscribe from marketing email using the link in any marketing message. Reply STOP to any text message to stop receiving texts. Transactional and service messages continue while your account is active.

9.3 Account Closure. You may close your account at any time as described in the Terms of Service. As stated in Section 7.1, closure does not by itself delete your information.

9.4 Opt Out of Sale or Sharing. You may opt out of the sharing of your personal information for cross context behavioral advertising by using the "Do Not Sell or Share My Personal Information" link in our website footer, by transmitting a Global Privacy Control signal, or by emailing support@landatlas.com with the subject line "Opt Out."

9.5 California Rights. If you are a California resident, the California Consumer Privacy Act as amended gives you the right to know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, the categories of third parties to whom we disclose it, and the categories sold or shared; to delete personal information we collected from you, subject to statutory exceptions; to correct inaccurate personal information; to opt out of the sale or sharing of personal information; to limit the use of sensitive personal information, which as explained in Section 2.5 does not apply to our practices; and to be free from retaliation for exercising these rights. We will not deny you service, charge you a different price, or provide a different level of quality because you exercised a privacy right. Sections 2, 3, 5, 6, and 7 contain the disclosures required by Cal. Civ. Code §§ 1798.100 and 1798.110.

9.6 Other States. Comprehensive privacy statutes in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states provide comparable rights. Most of these statutes define "consumer" to exclude individuals acting in a commercial or employment context, and Land Atlas users access the Platform for business purposes, so those statutes may not apply to your use of the Platform. We honor comparable requests where a statute applies, and we will not rely on the commercial context exclusion to deny a request a statute in fact grants. Where a statute provides a right to appeal a denied request, we will explain the appeal process in our response.

9.7 Exceptions. We may decline all or part of a request where an exception applies, including where retention is necessary to complete a transaction, detect or prevent fraud or security incidents, comply with a legal obligation, exercise or defend legal claims, or maintain tax or accounting records. We will explain the basis for any denial.

9.8 How to Submit a Request. Email support@landatlas.com with the subject line "Privacy Request," stating the right you wish to exercise and the account email associated with your request.

9.9 Verification. We will verify your identity before acting on a request to know, correct, or delete. Verification generally involves confirming control of the account email and may require additional information matching our records. Information provided for verification is used only for that purpose.

9.10 Authorized Agents. You may designate an authorized agent to submit a request on your behalf. We may require proof of authorization and may require you to verify your identity directly with us.

9.11 Response Timing. We will acknowledge a request within ten (10) business days and respond substantively within forty five (45) calendar days, extendable by an additional forty five (45) days where reasonably necessary, in which case we will notify you.

10ADDITIONAL DISCLOSURES

10.1 Automated Processing and Artificial Intelligence. The Platform uses algorithms and, in some features, machine learning and artificial intelligence systems to generate estimates, summaries, and other outputs. As described in our Terms of Service, these outputs may be inaccurate and must be independently verified before you rely on them. We do not use automated processing to make decisions producing legal or similarly significant effects concerning you.

10.2 Third Party Links and Integrations. The Platform links to and integrates with third party services. Their handling of your information is governed by their own privacy policies, not this one, and we are not responsible for their practices.

10.3 Financial Incentives. We do not offer financial incentives or price differences in exchange for the collection, sale, or retention of personal information.

10.4 Notice at Collection. Where required, we provide notice of the categories of personal information collected and the purposes of collection at or before the point of collection, including by linking to this Policy from account signup and from forms on our websites.

11CHANGES TO THIS POLICY

We may update this Policy. If we make material changes, we will notify you by email to the address on your account and by posting notice within the Platform at least thirty (30) days before the change takes effect, except where a shorter period is required by law. The "Last Updated" date above reflects the most recent revision. Prior versions are available on request. Continued use of the Platform after the effective date constitutes acceptance of the updated Policy.
